Willowtree Planning have closed out the Month of April to achieve one of our most valuable wins in the The Land and Environment Court of NSW.

On behalf of Moorgate Property, we are pleased to announce that approval has been granted by the Court in the matter of Moorgate Mosman Pty Ltd v Mosman Municipal Council [2023] NSWLEC 1188 for the construction of a residential flat building at 187-189 Spit Road, Mosman.

The development, as approved, comprises:

-Demolition of the existing dwelling houses and structures on the site
-Construction of a four storey residential flat building comprising six units
-Excavation and construction of basement carparking
-At grade access from Spit Road to a car lift via Level 2
-Associated landscaping, civil works and communal open space areas.

This matter presented unique challenges, notably the site levels and relationship to the streetscape to achieve a superior urban design outcome. Accompanied by 3 x Clause 4.6 variations for building height, floor space ratio and wall height, a precise planning and legal strategy was executed to present in the hearing to support the proposal.

The development represents a contemporary and sophisticated response to what can only be described as a challenging site.
